David’s practice spans property and commercial law, with a focus on the retirement village, health and aged care industries. He has worked with a range of clients – not only in private practice but also as in-house counsel at one of Australia’s largest private hospital operators, and more recently as General Counsel for a leading provider of high-quality retirement villages and one of Australia’s largest providers of quality in-home care and aged care services.
David's broad and varied experience has given him a genuine understanding of the issues faced by clients and the importance of offering practical and commercial solutions.
He offers real industry knowledge of the various issues arising under the Aged Care Act (Cth) and Retirement Villages Act (WA). David has prepared compliant residence contracts and home care agreements; advised on legislated disputes and complaints processes; and helped clients respond to various legislative changes including the introduction of consumer-directed aged care (CDC), and significant reforms to the WA retirement village laws that were introduced between 2014 and 2016.
David is familiar with legal frameworks used for delivering various forms of health and aged care – whether delivered in a hospital, home or residential care facility, and whether on a Government or privately-funded basis. He is experienced with development and redevelopment processes, and leasing and sales processes (including off the plan) within the industries he assists.
David has advised local governments and developer clients on issues arising under the Planning and Development Act (WA) and also has broad property law, commercial and corporate governance experience. He has been a Company Secretary of a large corporate group and is currently sitting on the board of a not-for-profit active in Perth’s northern suburbs.
David holds an LLB (Hons) and BA (Communication Studies) from the University of Western Australia, along with post-graduate qualifications from the Australian National University and the Governance Institute of Australia.
